Thank You! This situation is causing me big time stress. I have consulted with one lawyer, he did not suggest this, possibly because I was talking bankruptcy. What type of attorney should I look for? On my original summons, they do have the copy of my agreement with the credit card company. It also states that they are the assignee of Capital One Bank. Since Capital One has it listed as a charge off in 1998 does this mean they sold it to them? NCO also tried to collect on it listing it as Capital One 2nds. On SOL's is it the State you first signed the agreement or the State you live in now.
