Help! Wanting to Serve Me a Civil Warrant

Hello,

Just got a phone call from a process server saying that he wanted to serve my husband with a civil warrant for a Providian credit card debt of $5,000. We live in Tennessee.

We have been making payments (sometimes late) for several years on this card. We have not made payments for 4 months.

We are self-employed with greatly flunctuing income. We do own our home and land.

What can I do about this -- is there any way to stop the lawsuit? I was not warned or told this was going to happen -- we just got the phone call out of the blue.

Our credit is not very good because of our fluctuating incomes -- but we have always paid every bill we owed. We make mortgage and car payments about a month late and credit card payments about 2 months late --

Advice anyone?
