I didn't mean the facts in the Nelson case. I meant the facts in a similar case against a creditor. In other words, just because the higher court ruled that a consumer can sue a creditor, there still has be substance to the case.

So, from here out, in the Ninth Circuit for sure, a lower court will not dismiss a claim against a creditor based solely on the fact that it is a creditor being sued.
