Fraud is always a specific intent crime. They must PROVE that at the time of the act you intended to defraud the other party. Remember that a person always has concerns about being able to pay their bills and the fact that you were out of a job at the time that you used the cards did not mean that you weren't going to have a job next month. Therefore, you had every reason to believe that you would be able to pay.
