Ryder is partially correct; judges will NOT automatically throw a case out if a CA attempts to sue on out-of-statute debts. The SOL defense MUST be used and backed up by the defendant in court, otherwise the CA will lie its way to a judgment in its favor. You MUST show up for your hearing to do this. The CA attorneys usually bet that the defendant will not show and that is why they win so much.
