Capital One is the one suing me, not First Resolution Management (Candian Corp.). Capital One was the original owner of this account. First Resolution Management sent me a letter stating that First Resolution Investment Corp. (Seattle, WA) was now the legal owner of this account. It also stated that First Resolution Investment Corp. was an affilite of Frist Resolutionn Management. Since First Resolution Investment Corp. isn't license in Connecticut and if they were to sue me I could use their non license in Connecticut as a defense. My thoughts on this is that Capital One can't sue me because they don't own account anymore and I can use not a party at interest as a defense. Neither First Resolution Management nor First Resolution Investment have sent validation even though I wrote them on April 24th and August 24th asking each time that they validate. This week I sent them an Estoppel Letter. Frist Resolution Investment Corp. is on my credit report, but it doesn't state that I am disputing them. It is listed as an installment loan with a date open of 06-2001, balance date 05-2002, monthly payment $0, and Balance Amount of $0. Therfore, I believe that First Resolution Investment is the legal owner of this account and was shock to receive Writ from the Court with Capital One Bank's name on it.

In answer to your question as to what type of application it was, if my memory serves me well I believe it was one of the ones that you get in the mail that states that you are Pre-Approved and you sign and send it back. To be honest I don't remember receiving this card at all, but I must of since its on my credit report. Not to say that credit report couldn't be wrong. However, I am quite sure if I did receive application I probably would have had to cross off mispelled name and put my name on it. Anything I receive always have my name spelled wrong. They always make me a male instead of female with their misspelling. Even my credit report misspelled my name and has me with the male version.
