I do not usually deal with questions of this type (thanks Linda !!) However several things I can comment on.

As I understand it,you are suing for lack of validation and continued reporting of an account?

IS the account , in fact yours? Is it within SOL? If so, then even IF you file suit for their infraction and win, you will be faced with a suit by them for the amount of the debt.

In addition, although I am no expert on the matter, all I have read of similar case law is that if they claim error, and can show that it was a clerical error, you will lose.

Now, if it is NOT your debt, and they have practiced an abusive and flagrant disregard of your rights, AND you have suffered proveable financial damage,then certainly you MUST sue them.
