I have a very past due account with American Express on a Corporate card. I recently lost my job with the company, but still owe a balance. I have now received a call from a collection agency demanding that I pay about 50% of the card balance up front, I told them this was impossible since I am still unemployed. I offered a payment plan which she said was unacceptable and she stated that I should seek legal counsel, since they would bring legal action.

I am seeking advice on how to respond. I thought about trying to send a payment to American Express itself, but when I called to get the address they told me that they no longer handled the account. It seems like I heard at one time that a collection agency couldn't sue an individual, but only the original creditor could (I'm not sure.) I don't really know what they hope to accomplish since the account is only in my name and I am unemployed and rent my home.

All advice appreciated.
