What you need to do first is stop talking to these CA jerks on the phone, it is pointless. All you need to do is get their name and address so you can send letters. Second, pull all 3 of your credit reports, one or more of them should show a 'date of last activity' for the account. That will help you determine if the SOL has expired or not. Whatever you do, do NOT send these theives any money. He has already violated the FDCPA when he said your wages would be garnished.. and that can't happen in PA (lucky you !). He's threatening legal action that he cannot take. Besides, it would take them winning a lawsuit in the first place so they can't just call ANY employer and get a garnishment in ANY state!! Get those credit reports, and get the sample validation letter out. Send it Certified, return receipt requested and keep all copies of your letters and the green cards. There are good validation letter samples at www.creditnet.com and at www.creditinfocenter.com too.
