I think you should SUE the so-and-so. Your daughter made an honest mistake -- not realizing which relative he was talking about. He went over the line calling her a liar. Did he tell her WHY he was calling? If he did, that’s a violation too.

Please sit down and talk with your daughter and make as accurate a description of the call as she can. Ask her, as best she can recall, to tell you exactly the words he used, not her understanding of them.

Then go after 'em. The Fair Debt Collection Practices Act allows automatic damages of from $100 to $1000, plus any "actual" damages that can be shown, plus lawyer fees. So go see a NM lawyer with some experience in consumer law. Check with Legal Aid (or whatever name it has there). They probably won't be able to represent you, but are likely to know of some good lawyers who can.
