I was wondering if someone (Why Chat or otherwise) could tell me what kind of evidence that the CA is going to have to have in court in order to be able to hold up a lawsuit against me?
I have a repo case that is many years old but I think is still within the SOL. If you remember my case I live in MI, the original signed contract was in NV, and the car was repoed in New Mexico. I haven't paid on this account in 5 years. Car was repoed and sold between 2/98-5/98. So I am being taken to court and plan on fighting with whatever argument I can. (talking with a lawyer this week) Although I will throw in here that I have all of the paper work they have EVER sent me and lots of it has the wrong info on it. The car they state that they would be selling wasn't even the car that they repoed. Also, they never said where it would be sold and never showed how much they sold it for. Do they need to?
What will they need to have as proof in court for them to win this case?

Also, what is the story on "collection agency vs. they bought the account". Who needs the license and how do they prove they are either a CA or that they bought the account?
Hope these questions make sense. Once again, thanks for all of the help that we are all receiving here. I feel like I am gaining so much knowledge from just reading these posts.
