A Judgement was rendered against me and my husband at the time in August of 1993. We subsequently divorced in September 1995, and under the terms of the divorce decree he assumed all liability for the Judgement. My ex-husband filed personal bankruptcy in 1999 and the Judgement debt was discharged. I purchased a home in 1999 and attempted to refinance earlier this year, and the Judgement appeared on the Title search. I talked to my ex-husbands bankruptcy lawyer and evidently I am still on the hook for the Judgement, regardless of what the divorce decree stated. I have also learned that I have no recourse against my ex-husband because the debt was discharged in his personal bankruptcy. No action in any form has been taken by the Judgement Creditor to collect the Judgement. Judgements in Texas are good for 10 years. The Judgement will expire in about 10 months (August 2003), but there is a 2 year refile window. Does anyone know if I can force the Title Company to remove the Judgment from a Title Report if the Judgement has expired, but the refile window is still open?????
