Have you explained this to the lender? There are many ways for them to handle this if they want to. How much is the CA saying you owe? Has this affected your scores? And will it affect your interest rate? When you find your paperwork take it to a good consumer attorney. Maybe you can make these slugs (and MBNA) pay for your new house for you ;) or at least the downpayment.
