You co-signed in 94 and it went delinquent in 96. Was it between 94 and 96 that you were married? Were you both living at the same address in 94? Have you moved since then? Was the car sold? Did you ever get notice of it? Did you notify the creditor of any change of your address?

There are many questions, other that the sol issue, to a situation like this. Cosigners must be notified if there is going to be a sale of the property. The burden is on the creditor to show that notice was sent to you.

I can't answer the sol question but, it is possible that either the notice to you was defective or there was no notice given. If either is true, that's a defense also.
