Ladynred, Some states will allow a process server to leave a lawsuit with anyone over the age of 18 if they are at he defendants address. The theory is they are old enough to be in charge of the houisehold. Actually, leaving them with a receptionist was pretty smart. I knew a guy who tried to get a judgment overturned on the grounds of improper service-they left them with the receptionist. The judge asked her if part of her job was to see that other people in the office got their messages. SHe said yes. The judge asked if she was still employed at this office. She says yes. The judge says well, sounds like you do your job or they'd have fired you. I believe you did inform Mr. Smith of the presence of the process server and the lawsuit he left behing and he chose to ignore it. Judgment was not vacated. Why Chat is right. Never ignore a summons.
