Thank you for your previous advice. I obtained my credit report from Equifax and it does show a last activity date of March 1998. So I can use the SOL as a defense!(4 yrs in Florida)

You did mention in a previous reply that I should have received instructions on how to reply to the Court in reference to the law suit. I did not. The summons does appear to be legitimate. Do I need to reply or do I just show up on the court date? Also, should I provide a copy of the credit report of the account in question to prove the last activity date?

Do you think that the CA realizes that the SOL has passed and is just hoping that I will pay? There was a form attached for me to set up a payment schedule if I did not want to have to go to court over this.
