hi, hope someone can help with this. my husband
was served a summons last march2002, for a credit
card debt, that we got behind on and then couldnt pay
to catch up, with overlimt&late fees. the last d of activity was 8/97, the summons stated statue 47, for florida, where we live, and in looking at that it is for prommisory notes,not credit cards, this summons is full of weird things, and the default rate of int. in it and that we have been charged is wrong, they say 22%, not what agreement says. he ended up signing a stipulation of settlement for 12,100+$, for a 5,000 debt(orginally), and in it it says that if he defaults on this agreement, they will enter final judgement. at that time we did not know about the sol, etc. what can we do at this point? we have been paying a high monthly payment that is killing us, on a debt that they no longer were legally able to sue us for, and they are making us pay too much(wrong rate of int22%),
can we go to the court, or if we quit paying and they enter judgement , could we have it vacated? what does vacate a judgement mean? please help, we were taken advantage of by this co. know this is long , sorry
