I've seen posts on other boards where the validation, or the failure thereof, DOES work in court. If you have requested validation and they have either failed to respond or failed to provide proper validation, then that IS in your favor in court. Its even more in your favor if they show up in court and still do not produce proper validation per the FDCPA. The FTC opinion letters on Wollman, Brennan and Case all state what MUST be provided as PROPER validation. According to the Wollman letter, producing only a signed contract is NOT complete validation as far as the FDCPA is concerned.
