I just got a call from my employer saying that they recieved a garnishment notice from Allied Interstate Inc. for 471.04. two months ago I set up a payment plan with them, they sent me out coupons for the 20.00 a month payment(which I have made two payments both 2 weeks early). Last month they called me and said that the amount wasn't high enough and they would procede with garnishment. Can they do that? Can they garnish my wages without a court order, do they have to notify me of the court order? This is from a student loan guaranteed by the state of Michigan which I defaulted on in June of 96. The loan itself was paid off last year with my tax return. This balance of 471.00 is for collection fees, which I was told can not be taken from you income tax return. My employer said that they would start on my next check. They are only taking 47.00 a pay period out, but it is just the point that I set something up with them and they went back on their word. Please help
