Confused

Hello Everyone...I hope someone here can give me some advice on this...I am terribly confused. My husband accquired a Bank of America account last December when we purchased our home. The balance on the account is now 3k, we have not made a payment on the account since July because my husband had to take off work due to an injury and naturally, we fell behind. I recieved a phone call from some "attorney" yesterday telling me Bank of America is suing us and asking if we would like to settle this out of court. I have never recieved any letter from anyone about this..it was a total shock. She proceeded to tell me we had to pay at least 1k before the 27th of November or we would have to go to court??? Does this sound legitimate?? Should I even entertain this nonsense, or wait for something in writing?? I do not want to give into a scam here. Thanks so much for your help. Dana
