Deposit with C/C

Hello all, We live in California and recently phoned in a deposit for a used vehicle in Texas. The lender in Calif is refusing to finance the vehicle in Texas for smog reasons, so we are withdrawing our interest. The dealer is indicating that the C/C charge may not be refunded. ALL exchanged documents, including the C/C reciept for the deposit, have absolutely no admonishment or consumer notice/warning statements that the deposit will not be refunded if the sale is not completed. Is there any recourse for use to get back our deposit? Also, would this be a Federal Truth in Lending Regulations matter or one for the Texas OAG?
