In a perfect world with informed judges and a reasonable court system "Scott" would be correct. However, given that almost all (and I only corresponded with about a dozen) lawyers in Mo. were completely oblivious to their own State's contract law, and one could not presume the judge to be any more informed than they were, I think QB did the right thing.

The CA would have to be an IDIOT to refile, since he received a complete filed answer giving the SOL defense.
