Can you tell from the account statement they sent you when your last payment to Sears was without late charges or past due balances? It is true that current law requires a chargeoff after 180 days delinquency, however back in 1997 this was not the case, Sears particularly kept stuff on their books with added fees and late charges for a LONG time before charge-off. What is the date of the last charge on the account, that they sent you a copy of? In addition, I THINK NY is one of those States that may have a shorter SOL for store accounts. I will look it up and post back with the information.
