What is the rule on this?

In May of 2002, I got a credit card for my friend under my name. We had a verbal agreement that he would make the payments. Two months later, the card was maxed out and he hasn't made any of the payments. He says that he has a cash settlement coming but I don't believe him. Should I take him to court? Should I get him to sign something? Will the court rule in my favor? Please help me out here.
