Wonderful people of the message board:
At the beginning of this year, I lost my job. I've since sold my house, most of my valuable possessions and my second vehicle. The remaining vehicle (truck) has been difficult to keep current, but I have done a reasonable job. Due to family troubles, I had to make a trip several months ago. My truck fell a payment behind. After returning home, I called the creditor (GMAC) and explained to them what happened, and told them when I would be able to bring the loan current. We agreed on 30 days to bring it current. 10 days after that, a man saying he had been hired by GMAC to repo my truck showed up at my parents house, nearly 1700 miles away from where I live. I have never lived at that address. The vehicle has since been brought current. I believe that the individual in question violated several laws, however. 1. I have never lived at that address. 2. He showed up in the neighborhood at 8am, and did not leave until approximately 10:30 pm. 3. Since no-one was at my parents house, he proceeded to talk to all the neighboors. He told them who he was, who he was with, and that he was there to repo my truck. He asked them all if they knew where I was, and when I might be home. They all told him that I had never lived there. 4. At approximately 10:00pm, when my parents arrived home, he had a very argumentative conversation with my father. My father informed him that I did not live there, and asked him to leave the property. At this point the man became beligerant. Apparently he screamed obscenities at my father, screamed obscenities toward the street, and sped away leaving tire marks on the road. After several argumentative conversations with GMAC, they have finally admitted that he was hired by them. The representative I had talked to was on vacation, and another took it upon himself to attempt to repo my vehicle. When asked why they sent a repo truck 1700 miles from my home, I was told that they were "checking" if I lived there or not.
I believe they (and their contract repo man) commited enough violations of the fair credit act to allow me to go after them. If needed, I can take this to a lawyer, but I was hoping to write a complaint to the FTC and resolve the issue without the legal fees.
