check cashing companies

My mom wrote a check to a check cashing company about 1 1/2 yrs ago & has never paid the company for the check. They are now threating to turn her over to the police for theft & passing a bad check. My question is can they do that since they accepted the check knowing the funds were not available to begin with? Can she be arrested? Any help would be great
