I don't think so:

1) The check cashing company KNEW she didn't have the funds when she wrote the check or else she wouldn't be there in the first place.

2) I think they could sue her for the check but I'm not sure about criminal prosecution. It doesn't seem right. It's like signing a loan contract that state if you are five days late you will be subject to arrest.

It would be helpful for you to list your state. Each state has different bad check laws. WhyChat should have some good comments on this one as always. Stick around...
