judgement/lien on our property

What to do!! In 1995 my spouse was summons to court for a credit card sebt and didnt appear. He didnt receive the summons. At the time we were having marital problems BIG TIME. The years have gone by and we bought a house 2yrs ago at an OUTRAGEOUS interest! This was NOT my wanting to do, is buy another place.! Well we went to refi at a GOOD rate, lender said our credit was GREAT! I told him of the lien for 4430.00. We paid for our appraisal that the lender ordered and it was a good appraisal, enough to pay off that lien. Well, i contacted the collections about the lien and discovered that the balance was 8200.00 I about DIED! INTEREST over the years! So, i could not EVEN deal with that lady, so i called the origanil creditor about this. At first they told me that they could do nothing because the collections owned the account. Then i called to speak to the manager and pleaded for a lower amount. He agreed to the principal of 4430 and 2000. for the NASTY collector! Well, i went and borrowed 2000 on my credit card and paid that to the collections, i told them we could pay the 4500.00 balance through escrow in refinancing. And then what happens "ON the day we were to close our loan the underwriter stated we needed it writing that the forclosure we had was PAID FOR! WELL, it is and they KNOW IT!! On the credit report it shows its been redeemed!! I even foudn who bought my old house through Chicago title!Well, this put a STOP on our refinancing!! This collector isnt aware yet that we cant get the refi. She is giving us till this Monday th 16th and then i guess she's gonna GARNISH WAGES!! My LORD, cant i go directly around her and talk this over with the people we owe the money to and renegotiate? Cant i just explain what happened? I heard that they can take the account back from the collector if they wan to? Is this true? They already have been paid 2000 and we acually owe a principal balance of 2330 now. And if they agreed for a payoff of the 2330, can i get them to get the collections to REMOVE the lien on my house? Ive been SO DEPRESSED about this MESS!OH! and our lender required us to write to the other mortgage co about the forclosure being paid. Well, i sent it in writing along with 10.00 for there fee to find the file! Heard this takes 30 days to get this information! Im really TICKED at our lender for NOT telling me this when they checked our credit and SAID NOTHING about the forclosure, until the day we were to close loan and the GOOD rate we were to get EXPIRED!! Not only that, the loan office at H7R block "suddenly" does not WORK there anymore! I dont believe it! All i have is a bunch of emails from him during this loan process and one last message on my answereing machine from him stating "CAN YOU SIGN BY TUESDAY" I do have the TIL papers he sent. Dont i have ANY^ RIGHTS because after all HE approved us and he ordered the appraisal, not us!! Then he acted surprised about that!! He tried to act as if he had no knowledge of ordering the appraisal!!!"OH! BUT HE DID ORDER IT!!! I told him at the time, why was the aprasial 375.00 COD. He said to me, OH! didnt you order your own apprasial? I laughed, of course i didnt, "you" did. you told me so!! Where do i stand in this MESS
