I sympathize with any consumer who has to go to court to have a debt declared invalid. Believe me, I am going through the same thing with a creditor who refuses to honor a restrictive endorsement.

You do not have to wait to be sued in order to legally establish the validity/invalidity of the alleged debt. You may file a Motion for Declaratory Judgment today if you want.
