FTC Opinion Letters = not binding

No precedent either..

The only circumstances under which an OC has been liable under the FDCPA are when the OC has acted as a "debt collector." There has never been a published, decided case in which an OC (that was not classified as a "debt collector") has been liable under the FDCPA. NEVER.
