Spouse is regarded same as debtor,no claim there. However, depending on your State you may be able to get them on fraudulent extortion for a time-barred(past SOL) account and violation of fair business practices laws. If, however your State requires permission to tape, and you did not notify him you were taping, you cannot use it as DIRECT evidence.
