If you sent a request for validation, then the answer should be no, becuase suing you would be considered 'collection activity' which must cease when you dispute. However, that won't always stop them, they'll try it anyway and you can use that against them. If they fail to validate before court, you deny it in court because they have failed to prove its yours and they MUST prove it IN court in order to win.
