I do not know if unemployment benefits are exempt from garnishment, however, if they DO get a judgment against you (and I believe if you answer and fight them they will NOT) they may grab the $$ and you would have to pove they were exempt to get it back. So,yes, if you have a TRUSTED family member to open a joint account with (not a spouse),with THEIR name and ss# as primary, you would sleep better.

Do not contact the plaintff's lawyer with your problems about paying. The best way to answer is to deny their claim, give an affirmative defense if you have one, (like SOL) and answer you have no knowldge as to any other information about the debt.

If you tell them you can't pay because you are out of work, you are ADMITTING the debt is yours.

If you do this, (fight their claim) they may not be able to produce enough evidence of the debt being yours, and the figures being accurate, to win their case.
