debt sold to collection 2 years ago, placed this month

I had a sears account sold in 1999 to a collection agency. The collection agency placed it this month. Can the collection agency wait 3 years to place a debt on my cr report? Sears wrote it off in 98. It should have technically come off my report in 2005. Now it's there until 2009. Is this "LEGAL?"
