I am having an enormous amount of grief with Experian. I have a credit card with Chase. They made an error which resulted in a 30-day late notation on my credit report. The error was Chase's--the account was actually paid on time. Chase has confirmed the error and given me a letter confirming it was their error and that it should be removed from my credit report. I disputed the derogatory notation with Experian (via certified mail with return receipt). They "verified" it and left it on my credit report. I sent a followup dispute (again certified with return receipt) along with a copy of the letter from Chase confirming that it should be removed from my credit report. Again, they "verified" it and left it on my credit report. In both cases, more than 30 days passed between when they signed the return receipt and when their reply was postmarked. Since they're not going to fix something that is obviously incorrect, it seems that my best route is to sue them in small claims court. It seems like I have them on three violations of the FCRA: two for failing to respond within 30 days, and a third for failing to remove false information. (I think the letter I have from Chase is pretty good proof that it shouldn't be on my credit report.) Should I sue them for $3000 for the three violations in small claims court? Or is there a better way? I don't really want to sue them, I would be happy if this problem just disappeared from my credit report. But, I need some way to light a fire under them to get them to fix this and a civil suit seems just the thing to get them to pay attention. Any ideas anyone?
