Wow.. violations on top of violations !!

1- If they ignore your C&D letter, and you need to use WhyChat's for expired SOL debts, then they are violating the FDCPA - $1,000 for violations.

2 - Credit cards are NOT written contracts, they are considered open-ended accounts and the SOL for open accounts applies. This is defined in the Truth in Lending Act.

3 - If they start pulling your CR with hard inquiries, this is known as 'poisoning your file' and its a violation of the FCRA. The FCRA fines are $1000 PER VIOLATION so for every poison inquiry you can collect $1000 from them in court !

4 - They can't threaten legal action they cannot take per the FDCPA.

Stop talking to them and just send the C&D to them or their registered agent. If you need and address, we can get you one.
