First of all I know that this board deals mostly with Credit, but I am hoping that the right person reads this that knows a little bit about the legal side of things and can help me. I live in Illinois, and I have checked out the labor board site and am thinking about filing a claim. I have also contacted a lawyer, I just basically want a second opinion on this matter. OKay here goes,,, I worked for a company for about 6 months, recently quit because of her hiring someone under me and paying her more, I had bought a vehicle off of the owners son and had a written contract to pay the remaining balance of what the bank wouldn't loan to us to get it. I paid for the truck with a bank check from the bank where I got the loan, got the title and did all the necessary paperwork. Then when I quit, the employer (the other party's parents), held my whole paycheck this week for part of the payment on the truck to their son. They sent me a check for $0.00 with a copy of the contract that states that I will pay $50.00 a month due on the 30th of every month until the balance of the truck is paid for. Also included was a copy of my timecard, for 18.25 hours, my check should have been $115.30, (net pay). Can they legally hold my check? The lawyer said they couldn't and the state labor board website said that they can not deduct anything from my paycheck unless 1.) it was for taxes, 2.) to the benefit of the employee (health insurance, etc.), and 3.) a valid garnishment is in process (with the employee's written consent.
Any help you can give me on this will help, I did call her and explain these things to her and she said if I felt like i had to call the labor board, to go ahead and do that, she was not paying me by Monday like I asked her to do.
I am planning on calling the labor board on Monday, so any help before then would be greatly appreciated. Thanks in advance.
