I live in the state of Pennsylvania and am divorced. My ex-husband and I had a charge card with AT&T Universal. When the settlement agreement was signed, it stated that the ex would be responsible for AT&T Card and would not hold me liable or responsible. The ex has not paid on the card since September 2002. I wrote the charge card company a letter with a copy of the settlement agreement and the ex's new address and phone number. The bills are going to his home, not to mine. I got a call at work yesterday from a collection agency stating that they are sending me a letter regarding legal action being taken and how my wages can be attached. I never knew this was being turned over to collections. I didn't even know the card was not being paid and I don't even know how much the balance on the card is. I told the collection agency to contact my lawyer regarding this matter. Problem is, my name is primary on the card, the ex is the secondary. Was told that a settlement agreement does not hold up with a credit card company and they will still come after me. My attorney told me that I can try file a petition with the courts against the ex because he is not paying the card but the court, more than likely will deny the petition. I guess I'm basically screwed. Any help or answer's is greatly appreciated.
