Like so many others, I have begun receiving calls from Capital Acquisitions. Fortunately, they have not been threatening or harassing, like they have been to others on this board. In fact, sometimes they don't even leave messages on the machine. The first time they called - 12/02, I was caught off guard. He told me he was calling about a Visa from 1984. I know this is long out of the SOL and honestly don't even remember having such a debt. I asked him to send everything in writing. He refused, unless I agreed to pay. I told him that I wasn't paying anything until he sent everything in writing. He became rude, so I just hung up and told him if he called again I'd report him. Lucky for me I have caller ID and have been ignoring their calls ever since. I assume since the alleged debt is 19 years old, they bought this. Can they sue me? Am I obligated to pay? How can I make the calls stop? Since I hung up on them, I don't have their address or a reference or account number. Can I still send the SOL letter? Should I also send a C&D letter. I know I can probably just ignore them, but I don't want to live telling my kids not to answer the phone. Any guidance and/or sample letters appreciated.
