In response to some of the questions that came back, the vehicle was turned in Jan01, just about a year ago this month. It was purchased in Nov 99 and the first time the car was looked at for it's mechanical problems was about 4 or 5 months after purchase. I never submitted a final repair opportunity to the manufacturer and that's where I think my rights end, too late now, I've already given the vehicle back. I also forget to mention that they turned around and sold the vehicle at auction to someone else after I had specifically told them there were problems.

What I would really like someone to confirm for me is this: the credit collector said if I were willing to settle this it would clear my credit and my fiance's. He said that he would be put it in writing for me if I chose to pay them. Can they just say this and not have this removed from my credit just to get payment? or will it show up as a negative item on the credit report with no balance? Are they going to send a letter on my behalf clearing this charge-off/negative item? I would also send a letter to cover myself. How can I ensure that what they're telling me is actually what they will do? Can I sue them if this doesn't happen?
