I am filing bankruptcy (on my own) and was calling creditors to get the amount due and account numbers (on the accounts that were old). Anyway, one company that I called and inquired and TOLD THEM I was needing information because I was filing bankruptcy Chapter 7. They have a judgment against me for a medical bill. I went to the bank on Tuesday to get the cashier's check for the bankruptcy court and imagine my surprise when the bank teller told me there is absolutely no funds available in my account. This creditor filed a garnishment AFTER I informed them I was filing bankruptcy! I have filed with the court the Claim of Exemption Request for Hearing. Do I have a leg to stand on? Oh, also, one reason that I think the funds should be exempt is because 100% of the funds in the account (and this can be proven) are from student loans. Can other things besides income be garnished? Please advise and thanks in advance.
