If you haven't been sending the minimum demanded to bring the account current, they can sue you, simple as that - they even have the nerve to call it 'non-payment'. They'll keep taking your money for sure, that's all they want, but they obviously want MORE. You recieved a summons and you're required to file an Answer with the court, usually within a set time limit. Get your Answer to the court and then go to the court date - do NOT blow it off or they win by default and you'll lose all chances of negotiating either a payment plan or any kind of settlement.
