If trying to collect on a debt via mail is not "operating" in the State of NJ, then what whould the definition of "operating" be? I try not to "interpret" any statute - too big of a grey area. I figured going to the source would clarify it. I do agree that the language of the statute is ambiguous. It would seem to me that the Agency that enforces it would not give out mis-information. The response from the State of NJ was direct, any out-of-state CA attempting to collect in NJ needs to be bonded. And then again, you go to Court and it's anyone's guess as to how a Judge or Jury would interpret it. It should be interesting because we included this violation in a Federal lawsuit against the CA, along with a bunch of others. I'll update this issue if this ever goes to court. It's amazing that the CA's General Manager, "thanked my attorney" for advising them that they were not bonded in NJ, their contention was, "it's just one of those things that falls through the cracks". Yeah, like every other violation.
