I guess it is how the Courts interpret it.

Many States specifically say in their statutes that collection by foreign CAs is OK if it is by electronic or mail methods, however it is like the old question of what is "is".

Generally speaking, in commercial law, a business is not considered to be "operating" within the State if they have no physical presence within the State.N.J. goes somewhat beyond this and says a CA cannot solicit accounts in NJ even by mail or phone unless they are bonded.

Many States DO have restrictions against ANY collection activity by out of State CAs -- but NJ does not seem to be one of them.
