It is unlikely they will sue, however, you should be aware tat if they DO sue, and get a judgment, they CAN and will garnish your bank accounts, unless you have made sure the primary on any joint accounts is neither you or your spouse.

In addition, although you do not own any property NOW, a judgment lien in Tx is able to be exercised against FUTURE property ownership, so it would interfere with any possible home purchase in the next 10 years.
