Hello, I could use some advise. I am considering filing for Chapter 13 and have had my initial consult with an attorney. It will take me a few months to save up his fee though so I guess the calls will continue. I have read alot about the FDCPA but I have one creditor (the jewelers) that is making a lot of noise. As far as I can see they FDCPA does not apply to them because they are the original creditor. The call me numberous times a day and harass my husband at home...leave several vm messages for me at work a day and now they have started to transfer out of my voice mail to my associates and have started asking them if they can locate me or hold for me stating that it is a personal call. Once associate said that I was on an important call that I could not break away from and the caller then asked to be transferred to HR or payroll!! This put me in a very difficult position because what 'personal' caller would want to speak to hr or payroll on your behalf??? They called me yesterday and I told them that I was filing for chapter 13 and would give them my attorneys name as soon as I paid his retainer. They called again today and were very abusive and said that they have already verify employement with my supervisor and have started the paperwork with hr to garnish my wages. I thought they couldn't do that without suing you first.....at least that is what I thought my attorney said. This is so confusing and is really taking a toll on my husband who is disabled and at home all day as he gets the brunt of their calls. Can someone tell me do original creditors have to hold to the same standards as debt collectors? What are the laws regarding creditor harrassment? Thanks
