JR - i wish i could be of some better help but im far from an expert but im sure Whychat Lady or others will be able to offer lots more than i can provide .. the problem is with MBNA accounts since about 1999 or 2000 ALL their cardholders are subject to binding arbitration & MOST being over 95 % of their account holders have no idea that they fall under this nonsense agreement becouse again MOST were simply informed of this by simply adding an amending agreement to your account by simply sending it in with 1 of your bills in the past 2 yrs or so , i know messed up huh .. this is all still in the courts as we speak & MOST other big banks are not pursuing the arbitration clause that they MOSTLY all added also over the past 24 mths becouse like i say its in the courts but reguardless this wont help you at the moment if ever .. i know Ohio has a 4 yr SOL on credit cards so your ONLY 3 - 4 mths past due so thats not going to help you at the moment either .. i dont know what your financial situation is or type of other bills you have but if you have no other real assets & you really cant pay id do nothing at the moment & let them do what they feel BECOUSE if it gets bad where they start to garnish your pay or get judgements against you bankruptsy is always always an answer for you if needed & EVEN that crazy binding arbitration is 100 % dischargable .. wish i could be of more help .. just my opinion & goodluck , kel ................
