Hello Again, Whychat I went to your link and it was fantastic...thanks again! The PA standards are pretty much the same as the FDCPA as far as I can see except in regards to the cease and desist letters. My question seems to be one of a grey area though. Does anyone know what the legal line is where phone calls are now harrassment? I'm not talking verbal abuse because that is pretty clear but how many times can they call you a day, week? ABC Jewelers calls me twice a day...even if they talk to me the first time they still call back. Two different people from the same co. call me every day. They also leave several voice mail messages for me at work and as I have said earlier have started transferring to associates and bothering them to get me off the phone. They have been told not to call me at work but they do it anyway. When I try to transfer them to a supervisor so that my supervior can tell them not to call they hang up. I would like to know if I can press charges against them and what I would have to do to prove it. I could get statements from my associates and my supervisor re: the workplace harrassment. Can I record my phone calls at home without telling ABC Jewelers? This morning when they called I told them I was recording the phone call and they hung up on me so it doesn't look like they are going to let me get anything on tape. But I can prove harrassment if I can record at least the beginning of the call where they say their name and ABC Jewelers....before telling them that I am recording the call. Also, from what I understand...they cannot garnish your wages without first winning a judgement. They have flat out told me that they have already started the garnishment paperwork with my HR department and that it was a little to late for me to do anything about it now. Isn't this an illegal threat? Does my employer have to honor a request for garnishment if it does not come from the court? I did talk to my lawyer about the FDCPA, which unfortunately he knew nothing about and he told me to contact my attorney general's office of the FCC in regards to filing a complaint. I could swear though that he did tell me that they cannot garnish wages without first suing. Thanks!!
