You're confusing 2 different processes.

Charge-off is an accounting profit/loss write-off, that's it. They HAVE to charge-off at 180 days of non-payment.

A judgment is granted AFTER you're sued and you lose.

A creditor MAY sue after charge-off and win a judgment. A lot depends on how much you owe. There are some exceptions, like Discover, Providian, and Captial One who will sue regardless of the balance due.
