My husband and I won our civil complaint yesterday, basically upon the fact that nobody was there from the original bank to verify that the documents were true. As we were made aware by the "DJ", they or we have 30 days to file an appeal. We are both in fear that they will file an appeal and take us to a higher court for judgement. Their main subject and fact was that the document was signed under seal and that the new "House Bill" No. 1979, session of 1997, where they state that the new limitation is 20 years for instruments signed under seal. I have verified that the document is correct. However, I found a newer document from the "Senate Bill" No. 453, session of 2001 that states that this subsection shall not apply to consumer loans involving motor vehicles, boats or primarily for personal, family or household purpose. Now, do they still have a case by filing an appeal or does this Senate Bill superceed the House bill?? I live in PA, and this was civil suit for a deficiency on an automobile loan, defaulting approx, November 1994. HELP!!!
